At cardetail.be you will find a wide range of maintenance products for cleaning, treating and protecting the exterior and interior of your car. Also for professional accessories and equipment.
Article 2 - Applicability & conditions.
- These general terms and conditions apply to any offer by the entrepreneur and to any distance contract concluded between entrepreneur and consumer.
- We only deliver services in Belgium and the Netherlands. If you provide a delivery address in another country, we may refuse your order.
- To place an order, you must be at least 18 years old. If you are not 18, we ask that the order be placed by your parents or legal guardian. If we find that and order has been placed by a minor, we may refuse that order.
- Placing an order on the website constitutes express acceptance of our general terms and conditions of sale, which are always available through the website.
- If you order online, we will also provide you with a copy of these terms and conditions in a format that you can save or print out along with the order confirmation or at the latest upon delivery. We recommend that you always do this.
- If additional special terms and conditions apply in addition to these general terms and conditions, the above also applies to those special terms and conditions. Should our general terms and conditions conflict with those special conditions, you, the consumer, can always invoke the most advantageous text in your favor.
Article 3 - Our offer and your order
- If an offer has only a limited validity period or is subject to certain conditions, we expressly state this in our offer.
- We always describe as completely and accurately as possible what we are selling you and how the ordering process will go. In any case, the description is sufficiently detailed to allow you to make a proper assessment. If we use pictures, they are a true representation of the goods and/or services offered. However, to err is human, and if we are patently mistaken, we are under no obligation to still provide you. Images and product descriptions may possibly be different due to human error, recent updates or the like.
- Your order is complete and the agreement between us is final once we confirm your order by email and once we receive approval from the card issuer for your credit or debit card payment transaction. We accept payments via credit card or online banking. If your card issuer refuses to approve your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.
- To purchase a product, add the product to your shopping cart. Then enter your contact and billing information. In the last step you get a summary page, accept our terms and conditions and confirm your payment by pressing the order button labeled "place order". Once you have completed these steps, your purchase is final.
- You will receive your order invoice digitally as soon as we have processed your order. This processing is done manually on the same or next business day, unless otherwise indicated.
- In case of late payment by the Customer or problems with payments of previous orders, CARDETAIL is authorized to dissolve a contract.
Article 4 - Right of withdrawal
- If you buy goods or services from us, you have the right for 14 days from delivery or conclusion of the contract to decide that you do not want to keep the goods. You can then return your order without payment of a penalty and without giving any reason (you pay the costs for this yourself).
- Within 14 days after we have received your order back or you have indicated that you wish to withdraw from the agreement, we will refund you its full purchase price using the same means of payment with which you paid.
- The direct costs of returning the goods are therefore at your expense. We will indicate the cost of this or provide an estimate if this cannot be reasonably calculated in advance.
- We may wait to refund until we have received the goods back or until you have demonstrated that you have returned the goods, whichever comes first.
- During the first 14 days after delivery, we expect you to handle the order and its packaging with care. If you still wish to return the goods as described above, you may only unpack or use them to the extent necessary to assess whether you wish to keep the item.
- Returned goods may be fitted but must not have been used. If you are returning the goods, it must be done, if possible, together with the original packaging, with all delivered accessories and in the original condition and packaging and taking into account our instructions below.
- You can return your return package via mail or courier.
- We will send you an e-mail acknowledging receipt of your revocation.
Article 5 - The price
- During the period stated in our offer, our prices do not change, except for price changes due to changes in VAT rates.
- Our prices include all taxes, VAT, duties and services. This applies to deliveries within the EU.
- However, we may decide to charge shipping costs on top of the purchase price. In that case, we always notify you before you finalize your purchase.
- Additional shipping costs may apply for heavy and/or large items, as well as orders consisting of multiple boxes. However, this depends on the destination country. For large items, this will be indicated in the product description. For other exceptions, you will receive an email notification about this before we ship your order.
Article 6 - Payment
- We can only accept payment through the payment modules on our website.
- To ensure safe online payment and the security of your personal data, transaction data is encrypted with SSL technology over the Internet. You do not need any special software to pay with SSL. You recognize a secure SSL connection by the "lock" in the status bar of your browser.
Article 7 - Conformity and warranty
- We guarantee that our goods conform to your order and meet the normal expectations you may have of them taking into account the specifications of the product.
- Of course, we also guarantee you that our goods comply with all laws existing at the time of your order.
- Moreover, with regard to the delivery of goods, we apply the statutory minimum warranty period of two years if the good does not conform to the order placed. This means that if the goods are faulty or defective, they will be repaired or replaced free of charge up to 2 years after delivery.
- As far as possible and reasonable, you have the choice between repair or replacement. Only in case the repair or replacement is excessive or impossible or cannot be carried out within a reasonable time, you have the right to demand a price reduction or the rescission of the sales contract.
- If the defect or fault manifests itself within 6 months of delivery, it is deemed to have already existed before delivery, unless we can prove otherwise. After 6 months you will have to prove yourself that the defect was already present at the time of delivery.
Article 8 - Delivery and execution
- All goods and services will be delivered to the address you provide with your order.
- Wanneer een artikel in stock is wordt het aangeboden op uw leveringsadres in 1 à 5 werkdagen, afhankelijk van het land van bestemming.
- Wanneer een artikel niet in stock is, wordt het aangeboden op uw leveringsadres in 3 à 7 werkdagen. Hetzelfde geldt voor artikelen in nabestelling, tenzij anders aangegeven.
- Leveringen gebeuren door een door ons toegewezen transportfirma (Bpost, DPD of PostNL).
- If we cannot deliver on time, we will always notify you before the expiration of the scheduled delivery period. If we fail to do so, you may cancel your order free of charge. In that case, we will refund you at the latest within 30 days after cancellation.
- Our shipments are always done at our risk. So you don't have to worry about goods getting lost in the mail. However, if you return goods to us within 14 days of purchase because you prefer not to keep them, you are responsible for the transportation.
- If the goods delivered by us were damaged in transit, do not match the items listed on the delivery note or do not match the items you had ordered, you must report this as soon as possible and certainly within 3 days and return the items to us within 14 calendar days of receipt.
- Wanneer een pakket of de inhoud hiervan beschadigd werd tijdens transport, dan dient de klant ons te voorzien van de gevraagde foto’s zoals vermeld onder het hoofdstuk ‘Beschadigde producten en/of transportverpakking’ op https://www.cardetail.be/verzending. Transportschade dient binnen een redelijke termijn gemeld te worden, bij voorkeur binnen 7 werkdagen.
- We cannot be held responsible for any consequential damages due to late delivery or non-delivery by the carrier appointed by the company. Our liability in such cases shall be limited to the value of the items shown not to have been received by the customer.
- Additional charges may apply depending on the size, weight and chemicals in the shipment. This applies to both domestic and international shipments.
We always try to keep costs as low as possible, regardless of increased fuel prices or other issues that may affect transportation costs. We will always notify you by email of any surcharges. Your package will only be delivered after payment of the additional costs. - Annulatieverzoeken via e-mail kunnen niet gegarandeerd worden vanwege de verwerkingstijd van de e-mails. Mocht je om welke reden dan ook een bestelling willen annuleren, dan heb je de mogelijkheid om deze bij levering te weigeren, wat eventueel extra kosten kan helpen voorkomen. Voor dringende verzoeken raden we aan om telefonisch contact op te nemen met onze klantendienst.
Article 9 - Duration
- De Consument kan een overeenkomst die voor onbepaalde duur is aangegaan te allen tijde opzeggen met inachtneming van daartoe overeengekomen opzeggingsregels en een opzegtermijn van ten hoogste één maand.
- Een overeenkomst die voor bepaalde duur is aangegaan heeft een looptijd van maximaal twee jaar.
- Indien in een goederenovereenkomst van bepaalde duur is overeengekomen dat bij stilzwijgen van de Consument de Overeenkomst op afstand zal worden verlengd, zal de overeenkomst worden voortgezet als een overeenkomst voor onbepaalde duur en zal de opzegtermijn na voortzetting van de overeenkomst maximaal één maand bedragen.
- Wanneer een dienstenovereenkomst van bepaalde duur afgesloten tussen de Onderneming en de Consument een beding tot stilzwijgende verlenging bevat, wordt dit beding geplaatst in vetgedrukte letters en in een kader los van de tekst, op de voorzijde van de eerste bladzijde. Dit beding vermeldt de gevolgen van de stilzwijgende verlenging waaronder de bepaling van de hiernavolgende paragraaf m.b.t. de opzegging, evenals de uiterste datum waarop de Consument zich kan verzetten tegen de stilzwijgende verlenging van de overeenkomst en de wijze waarop hij kennis geeft van dit verzet. De Consument kan, na de stilzwijgende verlenging van een dienstenovereenkomst van bepaalde duur, op elk ogenblik zonder vergoeding de overeenkomst opzeggen met inachtneming van de opzeggingstermijn van maximaal twee maanden.
Article 10 - Force majeure
- In geval van overmacht zijn wij niet gehouden onze verplichtingen na te komen. In dat geval kunnen wij ofwel onze verplichtingen opschorten voor de duur van de overmacht, ofwel de overeenkomst definitief ontbinden.
- Overmacht is elke omstandigheid buiten onze wil en controle die de nakoming van onze verplichtingen geheel of gedeeltelijk verhindert. Hieronder begrijpen wij onder meer transportvertragingen, stakingen, brand, pandemieën zoals COVID-19, bedrijfsstoringen, energiestoringen, storingen in een (telecommunicatie-) netwerk of verbinding of gebruikte communicatiesystemen en/of het op enig moment niet beschikbaar zijn van onze website, niet of niet-tijdige levering van toeleveranciers of andere ingeschakelde derden.
Article 11 - Intellectual property
- Onze website, logo’s, teksten, foto’s, namen en in het algemeen al onze communicatie zijn beschermd door intellectuele eigendomsrechten die hetzij bij ons, hetzij bij onze toeleveranciers of andere rechthebbenden liggen.
- Het is verboden gebruik te maken van en/of wijzigingen aan te brengen in de intellectuele eigendomsrechten zoals beschreven in dit artikel. Het is niet toegestaan om foto’s, namen, teksten, productomschrijvingen, logo’s, kleurencombinaties, designs enzovoort te kopiëren of te reproduceren zonder onze voorafgaande en uitdrukkelijke schriftelijke toestemming.
Article 12 - Complaint resolution & disputes.
- We hopen natuurlijk steeds dat al onze klanten 100% tevreden zijn. Als je toch klachten zou hebben over onze diensten, kan je ons contacteren via info@cardetail.be of op het nummer +32 (0)474 28 30 78. We doen er alles aan om je klacht binnen de 7 dagen te behandelen.
- Op alle overeenkomsten die we afsluiten met onze klanten, ongeacht hun woonplaats, is uitsluitend het Belgische recht van toepassing en bij geschillen zijn enkel de bevoegde Belgische rechtbanken bevoegd. Indien om redenen van internationaal recht toch een ander recht van toepassing is, zal bij de interpretatie van huidige algemene voorwaarden in de eerste plaats teruggegrepen worden naar de Belgische Wet Marktpraktijken en Consumentenbescherming.
- Als consument geniet u bovendien van een wettelijke bescherming. Uiteraard stellen we steeds alles in het werk om uw klacht op te lossen. Graag informeren we u echter dat u met klachten ook terecht kan bij de Europese commissie U kan online uw klacht indienen op het ODR-platform via de volgende link: https://ec.europa.eu/odr/
